We reserve the right to correct errors and to limit quantities per customer or household.

When you use our client-side shopping cart and submit the checkout form with your name and email, you are submitting an order request, not completing a payment on the Site. A MacSwarthy representative will contact you by email to confirm product availability, configuration (such as color or storage tier), shipping options, taxes where applicable, and final pricing before any payment is collected through separate secure channels we provide.

Your order is not binding on us until we send a written order confirmation email. We may decline orders due to stock limitations, supplier restrictions, export controls, or suspected unauthorized resellers.

3. Pricing, promotions, and taxes

All prices displayed on the Site are shown in USD ($) unless otherwise stated. Promotional discounts, bundle offers, and coupon codes may include additional terms published on the Site or in marketing emails. We may modify or withdraw promotions at any time.

Final tax, duty, and shipping charges are calculated during representative follow-up based on your delivery location and product classification. You are responsible for any import fees imposed by carriers or customs authorities for cross-border shipments.

4. Product warranties and manufacturer support

Unless explicitly stated on a product page, electronics sold through MacSwarthy include manufacturer warranties rather than MacSwarthy warranties. Warranty registration, proof of purchase, and RMA processes may require information we provide in your order confirmation. We will assist with reasonable warranty navigation but cannot override manufacturer decisions.

Open-box, refurbished, or clearance items — if offered — will be labeled accordingly and may carry limited return windows described at purchase.

5. Shipping and delivery

Estimated delivery windows communicated during order confirmation are estimates only. Delays caused by carriers, weather, customs, or supply chain constraints do not entitle you to cancel paid orders except as required by applicable law. Risk of loss passes to you upon delivery to the address you confirm, unless otherwise mandated by consumer protection regulations in your region.

You agree to provide a deliverable address and to respond promptly to carrier inquiries. Failed delivery attempts due to incorrect addresses may incur redelivery fees.

6. Returns, exchanges, and cancellations

Return eligibility depends on product category, hygiene seals (for in-ear audio), and manufacturer policies for software-licensed devices. Unless required by law, opened software keys, digital downloads, and personalized configurations may not be returnable.

Items must be in original condition with included accessories. We may charge restocking fees for certain high-value electronics if permitted by law and disclosed in advance.

If you submit reviews, testimonials, or contact form messages, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content for marketing and support purposes. You represent that your submissions are truthful and do not infringe third-party rights. We may remove content that is offensive, misleading, or unrelated to our products.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACSWARTHY AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.
